Terms of Use

These Terms of Use (“Terms”) govern your use of the freewaytek dispatch platform (app.freewaytek.com) and the freewaytek-driver app for iOS and Android (together, the “Service”), provided by Freeway Tech Solutions Ltd. (“freewaytek”, “we”, “us”). By signing in to or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who the Service is for

• The Service is provided to trucking and freight businesses (“Customers”). Drivers, dispatchers and other users use it on behalf of the Customer that invited them.
• You must be at least 18 years old to use the Service.
• If you use the Service on behalf of a Customer, the Customer’s separate agreement with us (if any) also applies. If it conflicts with these Terms, that agreement takes priority.

2. Accounts

• Accounts are created by invitation only. Your Customer’s administrator controls your access and can remove it at any time.
• Keep your password confidential and do not share your account. You are responsible for activity under your account.
• Tell us or your administrator promptly if you believe your account has been accessed without permission.

3. Acceptable use

You agree not to:

• use the Service for anything unlawful, or upload content you do not have the right to share;
• try to access data belonging to another Customer or user, or get around security or access controls;
• interfere with, overload or disrupt the Service, or probe it for vulnerabilities without our written permission;
• copy, reverse-engineer or resell the Service, except as the law expressly allows.

4. Your data

• Information that a Customer and its users enter or upload belongs to that Customer. We use it only to provide the Service and as described in our Privacy Policy.
• You are responsible for the accuracy of the information you enter and upload, such as stop updates and delivery documents.

5. Text messages (SMS)

• Drivers may receive operational text messages, such as load assignments and updates, sent on behalf of their trucking company.
• Message frequency varies with load activity. Message and data rates may apply.
• Reply STOP to opt out. Reply HELP for help, or email admin@freewaytek.com.
• Mobile phone numbers and SMS opt-in consent are not shared with or sold to third parties or affiliates for marketing or promotional purposes.

6. Not a safety, navigation or compliance tool

The Service helps manage dispatch information. It is not a navigation system, an electronic logging device, or an hours-of-service or regulatory compliance tool. Do not use the Driver app while driving. Drivers and Customers remain responsible for safe operation and for complying with all transportation, customs and labour laws.

7. Availability and changes

We work to keep the Service available and reliable, but it may sometimes be unavailable, for example during maintenance or because of mobile network conditions. We may change or improve features over time.

8. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. Information extracted automatically from documents should be reviewed before it is relied on.

9. Limitation of liability

To the extent permitted by law, freewaytek will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount the Customer paid us for the Service in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

10. Suspension and termination

We or your Customer may suspend or end your access if you breach these Terms, if required by law, or when your Customer’s use of the Service ends. You may stop using the Service at any time and can request deletion of your account as described on our account deletion page.

11. App stores

If you downloaded the Driver app from the Apple App Store or Google Play, the store’s own terms also apply to your download and use of the app. For the Apple App Store, Apple’s Licensed Application End User License Agreement applies in addition to these Terms. Apple and Google are not responsible for the Service or for supporting it.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute relating to these Terms or the Service, unless the law where you live requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date above and, for significant changes, notify Customers or users through the Service or by email. Continuing to use the Service after a change means you accept the updated Terms.
